When a provisional order has been made against a member or members of a firm, and any one or more other persons, being a member or members of the same firm, is or are out of the Islands, or of unsound mind, the Court shall have jurisdiction, after giving the prescribed notices, to make a provisional order for the administration of the joint property of the members of the firm, on its being proved to the satisfaction of the Court that the firm is unable to pay its debts, but it shall not be lawful to adjudge any member a bankrupt under this section.
Upon such order being made, the property of the firm shall vest in the Trustee, and shall be administered in all respects as if a bankruptcy petition had been presented and a provisional order had been made in the first instance against all members of the firm.
