Transfer of persons in custody to or from the territory of the other Party

A person who is in lawful custody in the Islands may be transferred to the territory of any Party in response to a request by that Party for that person’s presence as a witness if that person and the Authority consent to such a transfer.
A person transferred under subsection (1) shall be considered to be in lawful custody during such transfer and during the period in which that person is in the territory of the requesting Party and such time shall count as if that person had been in custody in the Islands.
A person who is in lawful custody in a territory of any Party and who is transferred to the Islands upon a request by the Authority shall be considered to be in lawful custody during such transfer and during the period in which that person is in the Islands.
Any person who is transferred under this section may be released from custody upon such conditions as to bail or otherwise as may be agreed in writing between the Parties and may be released no later than the date on which that person would have been released if that person had not been so transferred.
