Application of Law; duty to nominate a Cayman Islands representative

This Law applies to a data controller in respect of any personal data only if —
the data controller is established in the Islands and the personal data are processed in the context of that establishment; or
the data controller is not established in the Islands but the personal data are processed in the Islands otherwise than for the purposes of transit of the data through the Islands.
A data controller referred to in subsection (1)(b) shall nominate, for the purposes of this Law, a local representative established in the Islands who shall, for all purposes within the Islands, be the data controller and, without limiting the generality of this provision, bear all obligations under this Law as if the representative were the data controller.
For the purposes of subsections (1) and (2), each of the following is to be treated as established in the Islands —
an individual who is ordinarily resident in the Islands;
a body incorporated or registered as a foreign company under the law of the Islands;
a partnership or other unincorporated association formed under the law of the Islands; or
any person who does not fall within paragraph (a), (b) or (c) but maintains in the Islands —
an office, branch or agency through which the person carries on any activity; or
a regular practice.
