Record of hiring dates

An employer shall maintain a record of each employee's hiring date together with a record of all temporary terminations and re-employments and, where there was a predecessor-employer, the employee's hiring date shall be that on which the employee was first hired.
An employee may request to see his record of hiring date and, if he does, the employer shall make the record available for inspection.
An employer who contravenes subsection (1) or (2) is guilty of an offence.
Where, by virtue of the fact that the requirement under subsection (1) was not in effect on the relevant date, there is no existing record of an employee's hiring, the employer and employee shall determine the hiring date by agreement and in default of agreement the hiring date shall be determined pursuant to section 49.
