Subject to any contrary provision in its constitution, a foundation company with enforceable duties under section 7(5) has a right to apply to the Court for an opinion or advice or for directions.
Section 48 of the Trusts Act (2021 Revision) applies for the application and any such advice, opinion or directions and the protection of the foundation company as if a reference in the section —
to a trustee or personal representative were a reference to the foundation company;
to trust money or assets were a reference to the foundation company ’ s assets; and
to a person interested in an application were only a reference to an interested person for the foundation company.
