Record of access to information

30. (1) The Registrar shall maintain records of the access to identification information in the register in such manner and for such period as may be prescribed.
A registered person shall be entitled to obtain from the Registrar, a record of access to that person’s identification information.
A requesting entity shall keep a record of every — Identification Register Act, 2022 Section 30 c Act 14 of 2022 Page 25
request for access to identification information in the register, including the purposes for which the request is made; and
access made to identification information in the register.
Notwithstanding subsection (2), the Registrar may withhold a record of access — cooperation purposes; official authorities (including regulation of the financial services industry); or
if it relates to the prevention, detection or investigation of crime;
if it relates to the apprehension or prosecution of a person who is suspected to have committed an offence anywhere;
if it relates to national security;
where disclosure of the record of access would be likely to prejudice the proper discharge of a public function in the case of —
public safety; offences, or of breaches of ethics for regulated professions; or including —
the prevention, investigation, detection or prosecution of criminal
a substantial economic or financial interest of the Islands,
compliance with international tax treaties or international
any monitoring, inspection or regulatory function exercised by
any monetary, budgetary and taxation purposes in the Islands;
where such access may impair the conduct of a criminal investigation or criminal proceeding; or
where so required by an order of a court.
Records of access that are withheld under subsection (4) may be accessed —
by an order of a court; or
except where access is being withheld subject to an order of the court under subsection (4)(f), by a public authority with responsibility for oversight of the requesting entity. Section 31 Identification Register Act, 2022 Page 26 Act 14 of 2022 c
