Classes of employees entitled to gratuities may be prescribed

36. (1) The Cabinet may, by regulations, prescribe classes of employees who are entitled to be included in the distribution of gratuities by a service employer.
Classes of employees may be prescribed for the purpose of subsection (1) by —
the description of their position;
the type of work they undertake;
the level of their remuneration; or
the terms of their employment, or by any combination of these matters.
