The Governor shall give to the persons interested in the land notice in writing of the occupation and of the purpose for which the land is needed, and shall, for the occupation and use of the land and for the materials, if any, to be taken from the land, pay to them such compensation, either by way of a gross sum of money or by way of monthly or other periodical payments, as shall be agreed upon in writing between him and such persons respectively.
Where the Governor and the persons interested differ as to the amount or form of the compensation or as to the apportionment thereof, the Governor shall refer such difference for the decision of the Court.
