Application

This Act does not apply to a person on the sole ground that —
that person has voluntarily sought treatment for a mental illness, serious mental illness or mental impairment; or
that person is acutely intoxicated.
For purposes of clarification it is declared that this Act shall apply to a person referred to in subsection (1) only if that person is certified as having mental impairment or serious mental illness under this Act.
