Compulsion by spouse or civil partner

A person is not free from criminal responsibility for doing or omitting to do an act merely because the act or omission takes place in the presence of that person's spouse or civil partner, but on a charge against a person other than for treason or murder, it shall be a defence for the accused person to prove that the offence was committed in the presence of and under the coercion of that person's spouse or civil partner.
