241. A person who commits a theft commits an offence and —
where the value of the thing stolen does not exceed five thousand dollars, is liable on summary conviction to imprisonment for seven years; and
where the value of the thing stolen exceeds five thousand dollars, is liable on conviction on indictment to imprisonment for ten years.
