Notwithstanding any law to the contrary, actions of the Director of Civil Aviation in the collecting of terminal charges and the assessment of penalties for non-payment of terminal charges during the period commencing on 1st October, 1997 and ending on 16th August, 2004 are —
validated; and
taken to have been lawful and valid, if the actions would have been lawful and valid had the terminal charges been collected and any penalties assessed in accordance with regulations made under section 27(d) of the Civil Aviation Authority Act (1997 Revision).
Notwithstanding any law to the contrary, actions of the Cayman Islands Airports Authority in the collecting of terminal charges and the assessment of penalties for non-payment of terminal charges during the period commencing on 17th August, 2004 and ending on the commencement of this Act are —
validated; and
taken to have been lawful and valid, if the actions would have been lawful and valid had the terminal charges been collected and the penalties assessed in accordance with regulations made under section 41(1)(k) of the Airports Authority Act, 2004 or the Airports Authority Act (2005 Revision).
For the purposes of subsections (1) and (2), an action of the Director of Civil Aviation or the Cayman Islands Airports Authority is not taken to have been lawful or valid if the action was done in bad faith.
