Restriction on development, etc. of certain biological weapons and toxins

Subject to sections 8 and 9, a person shall not develop, produce, stockpile, acquire or retain —
any biological agent or toxin of a type and in a quantity that has no justification for prophylactic, protective or peaceful purposes; or
any weapon, equipment or means of delivery designed to use biological agents or toxins for hostile purposes or in armed conflict.
A person shall not —
transfer any biological agent or toxin to another person or enter into an agreement to do so; or
make arrangements under which another person transfers any biological agent or toxin or enters into an agreement with a third person to do so,
if the biological agent or toxin is likely to be kept or used (whether by the transferee or any other person) otherwise than for prophylactic, protective or other peaceful purposes and he knows or has reasons to believe that that is the case.
This section applies to acts done inside or outside of the Islands.
Proceedings for an offence committed under this section outside the Islands may be taken and the offence may for incidental purposes be treated as having been committed in the Islands.
A person who commits an offence under this section is liable on conviction on indictment to imprisonment for life.
