Application for registration of trade mark as an object of property

Sections 35 to 39 apply with the necessary modifications, in relation to an application for the registration of a trade mark as in relation to a registered trade mark.
In section 37(1), as it applies in relation to an application for registration, the reference to the granting of the registration shall be construed as a reference to the making of the application.
In section 39 as it applies in relation to a transaction affecting an application for the registration of a trade mark, the references to the entry of particulars in the register, and to the making of an application to register particulars, shall be construed as references to the giving of notice to the Registrar of those particulars.
