Liability where offence committed by unincorporated entity

102. (1) Where a person that is a partnership commits an offence under this Act, the regulations or sectoral legislation, every partner, other than a partner who is proved to have been ignorant of or to have attempted to prevent the commission of the offence, commits the offence and is liable to be proceeded against and punished accordingly.
Where any other association, incorporated or not, commits an offence under this Act, the regulations or sectoral legislation —
every officer of the association who is bound to fulfil any duty of which the breach is the offence; or
if there is no such officer, every member of the governing body other than a member who is proved to have been ignorant of or to have attempted to prevent the commission of the offence, Section 103 Utility Regulation and Competition Act (2024 Revision) Page 64 Revised as at 31st December, 2023 c commits the offence and is liable to be proceeded against and punished accordingly.
