Any person charged with having committed an offence not punishable summarily may, on notice to the complainant, require that the evidence of any such person as in section 100 mentioned may be taken on behalf of the defence in like manner, and any deposition so taken shall be dealt with and be admissible in evidence on the same conditions as other depositions and on conditions corresponding to those mentioned in section 103.
