Monitoring, inspection or regulatory function

Personal data which are processed for the purposes of any monitoring, inspection or regulatory function connected with the exercise of a public function in cases of — are exempt from the subject information provisions to the extent to which the application of those provisions to the data would be likely to prejudice the proper discharge of the function.
public safety;
the prevention, investigation, detection and prosecution of criminal offences, or of breaches of ethics for regulated professions; or
an important economic or financial interest of the Islands, including —
compliance with international tax treaties or international co-operation purposes;
any monitoring, inspection or regulatory function exercised by official authorities (including regulation of the financial services industry); and
any monetary, budgetary and taxation purposes in the Islands,
Subsection (1) applies to —
a public function conferred on any person by or under any Law or regulations;
a function of the Crown, the Governor in Cabinet or a public authority; or
any other function of a public nature.
