Exemptions by regulations

Subject to subsection (2), the Cabinet may, after consultation with the Commissioner, by regulations —
exempt from subject information provisions personal data consisting of information, the disclosure of which is prohibited or restricted by or under any enactment; or
exempt from the non-disclosure provisions personal data consisting of information, the disclosure of which is made in circumstances specified in the regulations.
The Cabinet shall not grant an exemption under subsection (1) unless it considers the exemption to be necessary for the purpose of safeguarding the interests of data subjects or the rights and freedoms of any other individual.
