Entry and search of premises

In this Part —
“occupier”, in relation to premises, includes a person in charge of premises;
“premises” includes —
any ship, aircraft, vessel or other vehicle; and
any hovercraft or other floating or airborne contrivance,
registered in the Islands.
If a judge is satisfied by information on oath supplied by the Commissioner that there are reasonable grounds for believing —
that a data controller has contravened, is contravening or is likely to contravene any of the data protection principles; or
that an offence under this Law has been or is being committed,
and that there are reasonable grounds to believe that evidence of the contravention or of the commission of the offence is to be found on any premises specified in the information, the judge may grant a warrant to the Commissioner.
A warrant granted under subsection (2) may authorize the Commissioner or any of the Commissioner’s staff at any time —
to enter the premises and search them;
to inspect, examine, operate and test any equipment found there which is used or intended to be used for the processing of personal data; and
to inspect, examine and seize any documents, equipment or other thing found there which may be evidence of the contravention of subsection (2).
