General provisions relating to offences

A person who commits an offence under this Law is liable, except where this Law otherwise provides —
on summary conviction, to a fine of ten thousand dollars; or
on conviction on indictment, to a fine of twenty thousand dollars.
A fine ordered under this Law shall be in addition to any monetary penalty imposed by the Commissioner under section 55.
The Grand Court by or before which a person is convicted of —
an offence under section 16 or 54; or
an offence under section 46 relating to an enforcement order,
may order any document or other material used in connection with the processing of personal data and appearing to the court to be connected with the commission of the offence to be forfeited, destroyed or erased.
The Grand Court shall not make an order under subsection (3) in relation to any material if a person, (other than the offender), claiming to be the owner of, or otherwise interested in, the material applies to be heard by the court, unless an opportunity is given to the person to show cause why the order should not be made.
