The Management Authority may grant a transport certificate only if it is satisfied that the following conditions are met, —
that the Scientific Authority considers that the transport of the specimen will not be detrimental to the survival of any species listed in Column I or II of Part 1 or in Part 2 of the Schedule in any part of its range and that there are no other material conservation objections to the transport of the specimen;
in the case of a species listed in Column I of Part 1 of the Schedule, that the specimen will not be used for primarily commercial purposes;
in the case of a live specimen, that the proposed recipient is equipped to house and care for it suitably and that it will be handled so as to minimise the risk of injury, damage to health or cruel treatment; and
that the specimen has not been obtained in contravention of any law, including any international treaty or convention or foreign law.
A transport certificate is not required for the import, export, re-export or introduction from the sea of a specimen.
