The Director, in the circumstances mentioned in subsection (2), may order an administrator or any other person to take or refrain from taking any action in respect of a pension plan or a pension fund.
The Director may make an order under this section if the Director is of the opinion that —
the pension plan or pension fund is not being administered in accordance with this Act, the regulations or the pension plan;
the pension plan does not comply with this Act and the regulations; or
the administrator of the pension plan, the employer or any other person dealing with a pension plan is contravening a requirement of this Act or the regulations.
In an order made under this section the Director may specify the time or times when the periods of time within which the persons to whom the order is directed must comply with the order.
An order under this section is not effective unless the reasons for the order are set out in the order.
