Payment of commutation to surviving spouse

A surviving spouse to whom a pension is payable under section 35, 36 or 37 may elect prior to his benefit commencement date to be paid in lieu of such pension —
a reduced pension at a rate of not less than seventy-five per cent of the pension; and
a commutation lump sum cash payment of not less than twenty-five per cent of such pension.
