Possession of bullet-proof vest or firearm in association with gang

A person who, without lawful excuse, the proof of which lies on the person, has in that person's possession or under that person's care or control a bullet-proof vest or firearm for the use or benefit of, at the direction of, or in association with, a gang, commits an offence and is liable —
where the offence is in respect of a bullet-proof vest, to a fine of one hundred thousand dollars and to imprisonment for twenty years; and
where the offence is in respect of a firearm, to a fine of one hundred thousand dollars and to imprisonment for twenty years, subject to a minimum term of imprisonment of ten years.
