Client paying without approval to be liable to estate

Where a client pays the whole or any part of the amount specified in section 12 without the previous allowance of the Clerk of the Court under section 12 or the direction of the court, the client may, where the court is of the view that the client had not exercised due care in ensuring compliance with section 12, be ordered to account to the person whose estate or property is charged with the amount paid or any part of it for the amount so charged.
The attorney-at-law who accepts a payment in circumstances specified in subsection (1) may be ordered by the court to refund the amount received by the attorney-at-law where the court is of the view that the attorney-at-law has not exercised due care in ensuring compliance with section 12.
