Determination of disputes under the agreement

Subject to subsection (2), no action shall be brought in respect of a contingency fee agreement.
Where there is a question in respect of the validity or effect of a contingency fee agreement, the court in which the business or any part of the business was done, or if the business was not done in any court, the Grand Court, may, upon application by a person under subsection (3), enforce or set aside the contingency fee agreement.
The following persons may make an application under subsection (2) —
a person who is a party to the agreement;
a person who is or is alleged to be liable to pay the fees or disbursements in respect of which the contingency fee agreement is made; or
a person who is or claims to be entitled to be paid the fees or disbursements in respect of which the contingency fee agreement is made.
