Application for a tenancy order

An application may be made to the court by or on behalf of a prescribed person for a tenancy order vesting in the prescribed person the tenancy of any household residence —
of which the respondent is either the sole tenant or a tenant holding jointly or in common with the prescribed person; and
which is the household residence of the prescribed person or the respondent,
at the time of the making of the order.
Where the court makes a tenancy order under subsection (1) it may, if deemed to be in the best interests of a prescribed person, stipulate such terms and conditions as it thinks fit, including a condition that the respondent shall continue to maintain the household residence and pay the whole or part of the rent applicable to the tenancy.
