Entry in a dwelling place

An Authorised Officer may not enter a dwelling-place except with the consent of the occupant or under the authority of a warrant issued under subsection (2).
On application, a magistrate or Justice of the Peace may issue a warrant authorising the Authorised Officer named in the warrant to enter and inspect a dwelling-place, subject to any conditions specified in the warrant if the magistrate or Justice of the Peace is satisfied by information on oath —
that the dwelling-place is a place used for the purpose of the manufacture or sale of tobacco products;
that entry to the dwelling place is necessary for the administration of this Law; and
that the occupant does not consent to the entry, or that entry has been refused or there are reasonable grounds for believing that it will be refused.
An Authorised Officer, executing the warrant, other than a police officer, shall not use force unless —
he is accompanied by a police officer; and
the use of force is specifically authorised in the warrant.
