Consequences supervening or not known at time of former trial

34. A person convicted of an offence involving any act causing consequences which, together with such act, constitute a different offence from that for which such person was convicted may be afterwards tried for such last-mentioned offence if such consequences had not happened or were not known to the court to have happened at the time when the person was convicted.
