Defence of insanity at preliminary investigation

49. When an accused person appears to be of sound mind at the time of a preliminary investigation, notwithstanding that it is alleged that, at the time when the act was committed in respect of which the accused person is charged, the accused person was insane within the meaning of the law relating to capacity to commit a criminal offence, the court shall proceed with the case and, if the accused person ought, in the opinion of the court, to be committed for trial before the Grand Court, the court shall so commit the accused person.
