Effect of expungement in non-judicial proceedings

28. Where a question arises in a non-judicial proceeding with respect to a person’s criminal history, the person —
may answer in the negative; and
shall not be subjected to any liability or otherwise prejudiced in law by reason of any failure, in the answer, to acknowledge or disclose an expunged criminal record or ancillary circumstances.
