Failure to disclose expunged criminal record where disclosure required

Where a person who is required to disclose the particulars of an expunged conviction under section 33 fails to do so, that person commits an offence and is liable on summary conviction to a fine of five thousand dollars.
A person shall not be convicted of an offence under this section unless the court is satisfied that a benefit was conferred on that person and that such benefit would not have accrued if the person had not committed the act alleged to constitute the offence.
