Request for appeal etc.

A person affected by a decision of the Director may make an appeal under section 72 by notice in writing and shall deliver such notice to the Board not later than thirty days after the receipt of the Director's decision by the person.
On receipt of a notice of appeal under subsection (1), the Board shall appoint a time for the hearing of the appeal provided that the Board may refuse to hear an appeal if there are reasonable grounds to conclude that the appeal is frivolous and vexatious.
For the purposes of this section the parties to an appeal are —
the person who requests the hearing;
the Director;
an administrator;
any trustees of the pension plan;
any member of the pension plan; and
any employer who contributes to the pension plan.
Upon hearing an appeal, the Board —
may confirm, vary or rescind the decision appealed against; or
substitute its decision for that of the Director's, and may attach such terms and conditions to its order as the Board considers necessary.
The Board shall, by notice in writing, inform the parties to an appeal of its decision.
The Board may grant a stay of the decision appealed against on such terms and conditions as the Board considers appropriate in the circumstances.
A party to an appeal shall be given notice by the Board of the appeal and afforded an opportunity to examine before the hearing any written or documentary evidence that will be produced or any report the contents of which will be given in evidence at the hearing.
Documents in evidence at a hearing shall, upon the request of the person who produced them, be released to the person within a reasonable time after the conclusion of the hearing.
