Except where specifically provided otherwise, a person who contravenes this Act or any order made under this Act commits an offence and is liable on summary conviction to a fine of ten thousand dollars or to imprisonment for a term of one year, or to both.
Where a person is convicted of an offence related to the failure to submit or make payment to a pension fund or to an approved provider, the court may, in addition to imposing any fine, assess the amount not submitted or not paid and order the person to pay the amount to the pension fund or to the approved provider.
No summary proceedings under this Act shall be commenced after five years after the date when the subject matter of the proceeding was reported to the Director.
After obtaining the written consent of the Director of Public Prosecutions, the Director or Deputy Director may institute criminal proceedings for any offence under this Act, and may appear before the Court to conduct the prosecution in respect of the offence.
