Transfer of public officers to Authority

A person who is a public officer immediately before the 1st July, 2004 may, on or after that date, be offered employment by the Authority and, if that person accepts the offer, shall become an employee of the Authority on the same terms and conditions as those applicable to that person on the day immediately preceding such date except —
to the extent other terms and conditions are agreed between such employee and the Authority; and
that disciplinary matters shall be dealt with in accordance with the Labour Act (2021 Revision) and the disciplinary rules and procedures of the Authority and not under General Orders.
Pension arrangements and medical benefits relating to any employee specified under subsection (1) shall be subject to sections 16 and 17 respectively.
The Cabinet may, subject to such conditions as it may impose, approve the appointment of any public officer in the service of Government by way of secondment to any office with the Authority, and any public officer so appointed shall, in relation to discipline, salary, pension, gratuity or other allowance and to other rights and obligations as a public officer, be treated as continuing in the service of Government.
