Subject to section 47 of the Water Authority Act (2022 Revision), where the Chief Environmental Health Officer has not undertaken the performance of the service in question, the Cabinet may make regulations requiring the occupiers of premises in that part or parts of the Islands to remove and dispose of, at specified intervals, their house refuse, and garbage, or as the case may be, to cleanse at specified intervals their earth closets, privies, septic tanks and cesspools: Provided that no work done under this subsection shall create a nuisance.
Subsection (1) shall not apply to the extent that it is inconsistent with section 47 of the Water Authority Act (2022 Revision).
