Whoever, knowingly casts, causes or permits to be cast into any place designed for the reception of refuse, any rubbish infected by an infectious disease without previous disinfection, commits an offence and liable on conviction to a fine of one hundred dollars and if the offence continues, to a further fine of fifty dollars for each day during which the offence so continues after the service of a notice under subsection (2).
A Medical Officer of Health shall cause a notice of the provisions of this section to be served on and explained to the occupier of any house or part thereof in which there is a carrier or person suffering from an infectious disease and, on the request of such occupier, shall provide for the removal and disinfection or destruction of the aforesaid rubbish.
