Renewal of registration

The registration of a trade mark may be renewed on the application of the proprietor, subject to payment of the prescribed renewal fee.
An application for renewal shall be made and the renewal fee paid before the expiry of the registration.
Where the application for renewal is not made before the expiration, the registration lapses.
Notwithstanding subsection (3), where the application for renewal is made and the fee paid within six months of expiry of the registration, the lapsed registration shall be restored.
Renewal shall take effect from the date of the expiry of the earlier registration.
Where the registration is not renewed in accordance with subsections (1) and (2), the Registrar shall remove the mark from the Register and publish its removal by way of notice in the Gazette.
The renewal or restoration of the registration of a trade mark shall be published in the Gazette in the prescribed manner.
The Cabinet may make regulations providing for —
the notification to the proprietor of a registered trade mark of the date of expiry and the manner in which the registration may be renewed before the expiry of the registration; and
the restoration of the registration of a trade mark which has been removed from the Register,
subject to such conditions as the Registrar thinks fit.
