Disclosure of Members' interests

If a Member has any personal or pecuniary interest, direct or indirect, in any matter which is to be determined by the Board, the Member shall, if present at the meeting of the Board at which such matter is to be determined, as soon as practicable after the commencement thereof, disclose the fact and leave the meeting, and shall not take part in the consideration or discussion of such matter or vote on any question with respect to such matter.
A disclosure under subsection (1) shall be recorded in the Minutes of the relevant Board meeting.
If the Board is in receipt of information indicating that a Member is in breach of subsection (1), the Secretary shall —
in writing, advise the Member of the information that is the subject of concern;
provide the Member with a copy of the information and allow the Member to provide an explanation; and
if the explanation is not satisfactory, provide the Member with a warning that, if the Member continues to breach subsection (1), criminal proceedings may be instituted under subsection (6).
If, after the process specified in subsection (3) has been completed, the Board is of the view that criminal proceedings should be instituted under subsection (6), the Board may forward its view to the Director of Public Prosecutions for consideration.
If, after the process specified in subsection (3) has been completed, the Board is of the view that the Member is no longer in breach of subsection (1), the Board shall advise the Member in writing of that fact and that the warning has expired.
If a Member fails to comply with subsection (1) after receiving a warning under subsection (3)(c), the Member commits an offence and is liable on summary conviction to a fine of five thousand dollars or to imprisonment for a term of six months, or both.
No act or proceeding of the Board shall be questioned on the ground that a Member contravened this section.
