Presumption of death

Where the Court is satisfied that for a period of at least seven years immediately preceding the presentation of an ex parte petition by a party to a marriage, or civil partnership, that the other party to the marriage, or civil partnership, has been continuously absent from the petitioner, and the petitioner has no reason to believe that the other party has been living within that time, the Court may grant a decree of the presumption of the death of such other party.
