138. A person who, being the master of a ship, fails without reasonable cause to comply with section 137 commits an offence and is liable upon conviction —
in the case of a failure to comply with section 137(1)(a), to a fine of ten thousand dollars and to imprisonment for six months; and
in the case of a failure to comply with section 137(1)(b), to a fine of five thousand dollars, and, in either case, if the person is a certificated officer, an inquiry into the person’s conduct may be held and the person’s certificate cancelled or suspended.
