Indecent assault on a male person

145. (1) A person who makes an indecent assault on a male person commits an offence. 3
A boy under the age of sixteen cannot in law give any consent which would prevent an act from being an assault for the purpose of this section.
A male person with a mental disorder cannot in law give any consent which would prevent an act being an assault for the purpose of this section, but a person is only to be treated as having committed an indecent assault on a person with a mental disorder by reason of that incapacity to consent, if that person knew or had reason to suspect the said person to have a mental disorder.
A person who commits an indecent assault on a male person is liable on conviction on indictment to imprisonment for ten years.
A male person who commits, is party to the commission of or who procures or attempts to procure the commission by any male person of an act of gross indecency with another male person commits an offence. [ 3 see note 2 on p. 136]
