Unqualified persons not to drive

A person who drives a vehicle on a road while not being qualified to drive that vehicle commits an offence and is liable on summary conviction to a fine of four thousand dollars or imprisonment for a term of twelve months, or to both.
Where a person is charged with —
a contravention of subsection (1), the burden of proving that that person was licensed lies on that person; and
being an accessory to a contravention of subsection (1), the burden of proving that the person who was driving was licensed lies on the alleged accessory.
