Protection for hospital patients

86. (1) While a person is a patient at a hospital that person shall not be requested to provide a specimen of breath for a breath test or to provide a specimen for a laboratory test unless the medical practitioner in immediate charge of that person has been notified of the proposal to make the request and —
if the request is then made, it shall be for the provision of a specimen at the hospital; but
if the medical practitioner objects on the ground specified in subsection (2), the request shall not be made.
The ground on which the medical practitioner may object is that the request or the provision of a specimen, or in the case of a specimen of blood or urine, the Section 87 Traffic Act (2026 Revision) Page 64 Revised as at 31st December, 2025 c request under section 84, would be prejudicial to the proper care and treatment of the patient.
