A person who, whether for payment or not, provides goods and services or makes facilities available, shall not discriminate against another person on any ground specified in section 3(2) —

by refusing to provide that person with those goods or services or to make those facilities available; or

in the manner in which or in the terms and conditions on which those goods or services are provided or those facilities are made available to that person.
