Sexual harassment

Any act of sexual harassment constitutes discrimination based on sex within the meaning of section 3.
A person shall not commit sexual harassment against any other person.
In deciding whether conduct has the effect referred in subsection (4) the following must be taken into account —
the perception of the person against whom the sexual harassment is alleged to have been committed;
the other circumstances of the case; and
whether it is reasonable for the conduct to have that effect.
In this section —
means unwanted conduct of a sexual nature against an employee by an employer or another employee —
in the workplace; or
in connection with the performance of, or recruitment for work,
which is threatened or imposed as a condition of employment on the employee or which creates a hostile working environment for the employee, being conduct which has the purpose or effect of violating the dignity of the employee or intimidating, degrading, humiliating or offending the employee.
