Where by virtue of any provision of this Part, a person is prohibited from discriminating against another person on any ground specified in section 3(2), the first-mentioned person discriminates against the other person if he requests or requires that other person to provide information (whether by way of completing a form or in the course of an interview or otherwise) that would not, in the same or substantially similar circumstances be required or requested of a person of the opposite sex or of a different marital status or pregnant state.
