Committal by summary court

Where —
a defendant is convicted of an offence by a summary court; and
the Director of Public Prosecutions asks the court to commit the defendant to the Grand Court with a view to a confiscation order being considered under section 15 , the summary court —
shall commit the defendant to the Grand Court in respect of the offence; and
may commit the defendant to the Grand Court in respect of any other offence falling within subsection
. ( 2 ) An offence falls within this subsection if —
the defendant has been convicted of it by the summary court or any other court; and
the summary court has power to deal with that person in respect of it.
Where a committal is made under this section in respect of an offence or offences —
section 15 applies accordingly ; and
the committal operates as a committal of the defendant to be dealt with by the Grand Court in accordance with section 64 .
Where a committal is made under this section in respect of an offence triable either way for which (apart from this section) the summary court could have committed the defendant for sentence under section 7 of the Criminal Procedure Code (2021 Revision) , the court shall state whether it would have done so.
A committal under this section may be in c ustody or on bail.
