Search warrant safeguards

44. (1) Notwithstanding section 26 of the Criminal Procedure Code (2021 Revision), or any amending or superseding version, this section has effect in relation to the issue to police officers under any Law, of warrants to enter and search premises; and an entry on or search of premises under a warrant is unlawful unless it complies with this section.
Where a police officer applies for any such warrant it shall be the police officer’s duty —
to state —
the ground on which the police officer makes the application; and
the Law under which the warrant would be issued;
to specify the premises which it is desired to enter and search; and
to identify, so far as is practicable, the articles or persons to be sought.
An application for such a warrant shall be made ex parte and supported by an information in writing.
The police officer shall answer on oath any question that the Justice of the Peace, Magistrate or Judge hearing the application asks that police officer.
A warrant shall authorise an entry on one occasion only.
A warrant —
shall specify —
the name of the person who applies for it; Section 45 Police Act (2021 Revision) Page 42 Revised as at 31st December, 2020 c
the date on which it was issued;
the Law under which it was issued; and
the premises to be searched; and
shall identify, so far as is practicable, the articles or persons to be sought.
Two copies shall be made of a warrant.
The copies shall be clearly certified as copies.
