Information to be given on arrest

62. (1) Where a person is arrested, the person is to be informed that that person is under arrest and of the nature of the offence for which that person is being arrested as soon as is practicable after that person’s arrest.
Where a person is arrested by a police officer, subsection (1) applies regardless of whether the fact of the arrest is obvious. Police Act (2021 Revision) Section 63 c Revised as at 31st December, 2020 Page 55
Nothing in this section is to be taken to require a person to be informed —
that the person is under arrest; or
of the ground for the arrest, if it was not reasonably practicable for that person to be so informed by reason of that person having escaped from arrest before the information could be given.
